Mediation with Elder & Vulnerable Adults who may lack Mental Capacity

In 2009 Craig Ward, Solicitor conducted a research programme examining whether or not mediation is suitable for mental capacity cases. Having consulted over 70 solicitors, the following points were found:

Solicitors recognise that mediation where one of the parties has lost mental capacity would be more effective and speedier, getting better results

Valuable court time could be saved at the Court of Protection by using mediation

Mediation with elderly clients could provide a more conducive environment to settling disputes.
